All our bikes are sold as is. No returns or exchanges allowed. However, we offer 30 days defective parts warranty on parts from the bikes that were purchased from us. This warranty does not cover labor. Defective parts must be returned to us before we issue new ones under the warranty. Motorbike Repair Shop WARRANTY OBLIGATION

   If any defect should be found in this Vehicle within the applicable Distributor’s Warranty term Motorbike Repair Shop only obligation is to have the part shown to be defective repaired or replaced, at Motorbike Repair Shop option, with a new, remanufactured or equivalent part without charge for parts, at an authorized Motorbike Repair Shop dealer or distributor when Motorbike Repair Shop acknowledges that such defect is attributable to faulty material or workmanship at the time of manufacture. All parts replaced under this limited warranty become the property of Motorbike Repair Shop. The owner is responsible for any repairs or replacements which are not covered by this limited warranty. Motorbike Repair Shop reserves the right to add improvements to, and/or change the design of any model at any time without obligation to make the same improvements or changes to models previously sold. We reserve the right to determine what damage is due to defective materials and what is due to product abuse or misuse.

 We shall not be responsible for any losses to the customer as a result of the failure of any part, including incidental or consequential loss or damage arising from injury, loss of use, loss of time, rental vehicles, loss of profits, or loss of income.

EXCLUSIONS - ITEMS NOT COVERED BY WARRANTY

The Manufacturer’s Warranty do NOT cover:

(a) normal maintenance services, including, without limitation, oil changes and adjustments to carburetor, oil pump, brakes, wheel spokes, clutch and/or valve clearance;

(b) the replacement of normal wear parts, including without limitation, all body fenders, all rubber parts (except front fork seals and engine oil seals), spark plugs, gaskets, bulbs, lenses, wires, cables, fuses, tires, tubes, brake linings, clutch plates, sprockets, wheel spokes, chains, filters, fluids, batteries, brakes, throttles cables, seats, lights and toggle switches, plastic parts (including color-coordinated housings) and damage to the engine or any other part due to abuse or misuse;

(c) any Vehicle which has been used for competition, like racing;

(d) any repairs or replacements required as a result of accident or collision;

(e) any repairs or replacements required as a result of misuse, negligence, abnormal or insufficient care, including, without limitation, piston seizure, or bent or broken valves;

(f) any repairs or replacements required as a result of modifications or alterations made to the Vehicle, including without limitation, the installation of performance accessories;

(g) any repairs or replacements required as a result of the use of parts or accessories not approved by Motorbike Repair Shop;

(h) Damage resulting from the failure to operate the Vehicle in accordance with the operating instructions in the Motorbike Repair Shop provided Owner’s Manual;

(i) any repairs or replacements required as a result of the Vehicle not having received, during the warranty term, the service inspections prescribed in the Motorbike Repair Shop provided Owner’s Manual;

(j) any Vehicle which has been assembled, disassembled, adjusted or repaired by a party other than an authorized Motorbike Repair Shop dealer or distributor; and

(k) any Vehicle which has been used for purposes other than what it was designed for (i.e. scooter designed for "on the road use" used as "off road Vehicle").

DISCLAIMER OF LIABILITY

Except to the extent provided in this limited warranty, Motorbike Repair Shop shall not be liable in contract, tort or otherwise for any direct, indirect, economic, commercial, incidental, consequential or special loss or damage or expense or claim howsoever caused, arising in connection with the sale, use, loss of use, performance or non-performance of the Vehicle (including, without limitation, Vehicle towing expenses and liability in respect to any other person).

NOTICE TO CONSUMERS

The terms contained in this limited warranty are not intended to limit, modify, take away from, disclaim or exclude any warranty which by law cannot be limited, disclaimed or excluded. To the extent that any applicable law prohibits any term contained in this warranty, such term shall be considered severable and deemed to be deleted from this warranty.

Riding a vehicle contains certain inherent risks. Riding a gas/electric vehicle is dangerous and serious injury or death is possible. Every vehicle's package includes written manual instructing that you practice extra safety measures to avoid injuring yourself and others. Motorbike Repair Shop strongly advises you to review all the safety instructions carefully before operation. Please, follow all rules and regulations in your area for operating an electric/gas vehicle. Do not allow others to use the vehicle without proper instructions. Remember to always operate your vehicle with the proper safety gear and helmet.
